GENERAL TERMS AND CONDITIONS OF USE

The purpose of these General Terms and Conditions of Use (hereinafter "GTCU") is to define the terms and conditions of use of the "www.onehealth.renaultgroup.com" website.

Access to and use of the Site implies unreserved acceptance of the TOU by the User.

1 - Definitions

For the purposes of these Terms and Conditions:

"Site" refers to the "www.onehealth.renaultgroup.com" website published by RENAULT giving access to the Elements. The Site includes the Content, the software, the programmes, the tools (programming, navigation, etc.), the databases, the operating systems, the documentation and all the other elements that make it up, the updates and new versions that may be made to the Site by RENAULT.

"Content" means, but is not limited to, the structure of the Site, editorial content, drawings, illustrations, images, photographs, graphic letters, brands, logos, acronyms, company names, audiovisual works, multimedia works, visual content, sound and audio content, as well as any other content present on the Site.

"Elements" refers to the various functionalities and information elements offered on the Site.

"RenaultGroup" refers to the various legal entities of the manufacturer Renault.

"User" refers to a natural person of legal age who browses the Site for their own needs, for strictly personal and non-commercial use, without direct or indirect profit.

2 - Purpose of the Site

The Site is a portal that allows the User to :

  • Follow the latest news from the OneHealth programme,
  • Offer all Renault Group employees tools and services to take care of their health and well-being,

This list is not exhaustive and may be modified at any time by Renault, without any liability on its part.

3 - Access to the Site

The Site can be accessed via the Internet at the following address

4 - Licence to use the Site

RENAULT grants Users a personal, non-exclusive, revocable, non-assignable and non-transferable right to use the Site, the Content and its Elements free of charge.

This licence is granted to the User solely for his/her own needs, excluding any commercial or lucrative use of all or part of the Content and/or Elements.

The User does not acquire any other rights over the Site, the Content and/or the Elements other than those granted herein.

5 - User obligations

The User undertakes to use the Site in accordance with national and international regulations.

In particular, they undertake to:

  • familiarise themselves with these TOU and comply with them,
  • not reproduce, even temporarily and/or partially, the Site and/or its Content, by any means and in any way,
  • not to access and/or use the software components of the Site,
  • not to use software or processes intended to copy the Content and/or which may interrupt the proper functioning of the Site,
  • not adapt, modify, translate, transcribe, compile, decompile, assemble or disassemble all or part of the Site, the Elements and/or the Content,
  • not export the Site and/or merge it with other computer programmes,
  • inform RENAULT if you become aware of any act of piracy and/or unlawful or non-contractual use of the Site and/or its Content,
  • not carry out any manipulation and/or introduce any virus or malicious code likely to cause computer and/or functional malfunctions likely to affect the proper functioning of the Site or any Elements accessible via the Site.
  • prevent the proper operation of the Site by any means whatsoever,
  • not using the Site to display, download or transmit any content contrary to decency or public order (such as, but not limited to, any content of a racial, political, religious, pornographic or sexual nature).

As the User is solely responsible for the use of the Site, he/she acknowledges that neither RENAULT nor the members of its distribution network may be held liable for direct or indirect damages, and in particular material damages, immaterial damages, loss of data or programs, financial damages, resulting from access to or use of the Site, or due in particular to the interruption, suspension or modification of the Site or one of its Elements.

6 - Availability of the Site

RENAULT undertakes to do everything possible to ensure the security of access to, consultation of and use of the Site.

The Site is continuously accessible, except in the event of force majeure or the occurrence of an event beyond the control of RENAULT, and subject to any breakdowns and maintenance operations necessary for the proper functioning of the Site.

7 - Liability - Warranty

Use of the Site

Within the limits of applicable laws and regulations, neither RENAULT nor the dealers in its sales network assume any liability for the use of the Site by the User and do not give any explicit or implicit guarantee as to the speed or performance of the Site. In particular, access to the Site may be temporarily and periodically suspended for technical reasons; in this case, the technical teams will endeavour to resolve the problem as quickly as possible.

RENAULT reserves the right to modify the information on the Site at any time and without prior notice, without RENAULT and/or the members of its distribution network and/or its subsidiaries being liable for this.

Access to and use of the Site is at the User's own risk. It is the User's responsibility to take all appropriate measures to protect their own data and/or software stored on their telephone and computer equipment against any attack.

In any event, RENAULT shall be exempt from any liability whatsoever:

  • in the event of non-compliance by the User with these TOU;
  • in the event of malfunction of the Site due to a cause, whether voluntary or involuntary, attributable to the User or to a third party or to an intentional act, to the software, to the smartphone/tablet, to an interface or to any other product or supply of the User;
  • in the event of a malfunction and/or failure of the User's computer and/or communication network, whatever the cause.

RENAULT does not guarantee that the Site will be free of any error or anomaly, nor that it may be subject to attacks, in particular by viruses, which may lead to malfunctions, interruptions, breakdowns or loss of data or information.

8 - Personal data

The use of the Site may require RENAULT to collect personal data allowing the direct or indirect identification of the User.

9 - Intellectual and industrial property

The Site and its Content are protected by intellectual and/or industrial property rights.

The photographs, texts, slogans, drawings, images, animated sequences with or without sound, as well as all the works integrated into the Site are the property of RENAULT or of third parties who have assigned their rights to RENAULT or authorised RENAULT to use them.

The vehicle models presented on the Site are protected by copyright and by Articles L511-1 et seq. of the French Intellectual Property Code relating to the protection of registered models.

The names RENAULT, the names of the Vehicles in the RENAULT range and the products and services associated with them, the slogans and logos accompanying these brands are, unless otherwise indicated, trademarks registered by RENAULT or by other companies in the Renault Group.

Other trademarks that may also be cited are used by Renault with the authorisation of their owner or simply as an indication of products or services offered by Renault.

Reproductions of the Content on paper or computer are authorised provided that they are strictly reserved for personal use, excluding any use for advertising and/or commercial and/or informational purposes, and that they comply with the provisions of Article L122-5 of the French Intellectual Property Code.

With the exception of the above provision, the reproduction, imitation, use or affixing, by any process whatsoever and on any medium whatsoever, of all or part of the Content without having obtained the prior authorisation of RENAULT or the holder(s) of the rights in question constitutes an offence punishable by four years' imprisonment and a fine of 400,000 euros.

10 - Applicable law

The Site and these TOU are governed by French law, without prejudice to the mandatory rules of the User's country of residence.

Any dispute concerning the interpretation and/or execution of these TOU must be settled out of court.

In the absence of an amicable solution, the dispute shall be referred to the courts within the jurisdiction of the Paris courts, to which the parties assign exclusive jurisdiction, notwithstanding multiple defendants or third-party claims for damages.

11 - Updating the GTC

RENAULT reserves the right to modify and update these GTC without prior notice, at any time and without informing Users in advance.

If applicable, the modifications and updates will be binding on the User as soon as they are published on the Site, and it is up to the User to consult the UGC in force each time he or she logs on to the Site.

12 - Miscellaneous provisions

12.1 No waiver

The fact that one of the parties does not avail itself of a provision of these TOU shall not be construed as a temporary or definitive waiver of the benefit of the provision in question, which shall remain in force.

 

12.2 Nullity of a clause

If one or more of the stipulations of these TOU are declared invalid, void or unwritten as a result of current regulations, a development or following a final decision by a competent court, the other stipulations will retain their full force and scope, with the parties undertaking, as soon as possible, to put in place a valid replacement provision with an equivalent scope that is as close as possible to the spirit of these TOU.

 

12.3 Force majeure

The following are expressly considered to be cases of force majeure, in addition to those usually accepted by the jurisprudence of the French courts: inclement weather, governmental and legal restrictions and modifications, computer malfunctions and telecommunications blockages, failure of RENAULT's servers and any other event beyond RENAULT's express control.
