GENERAL CONDITIONS OF USE

The purpose of these General Conditions of Use (hereinafter referred to as the "GTU") is to define the terms and conditions of use of the "www.onehealth.renaultgroup.com" website.

Access to and use of the Site implies unreserved acceptance of the GTU by the User.

1 - Definitions

For the purposes of these terms of use

"Site" refers to the "www.onehealth.renaultgroup.com" site published by RENAULT giving access to the Elements. The Site includes the Content, software, programs, tools (programming, navigation, etc.), databases, operating systems, documentation and all other elements of which it is composed, as well as any updates and new versions that RENAULT may make to the Site.

"Content " refers, inter alia, to the structure of the Site, editorial content, drawings, illustrations, images, photographs, graphic charts, trademarks, logos, acronyms, company names, audiovisual works, multimedia works, visual content, sound and audio content, as well as any other content present on the Site.

"Elements " refers to the various functionalities and information elements offered on the Site.

"RenaultGroup " refers to the various legal entities of the manufacturer Renault.

"User " means a natural person of legal age who browses the Site for his or her own needs, for strictly personal and non-commercial use, without any direct or indirect profit motive.

2 - Purpose of the Site

The Site is a portal that allows the User to :

  • Follow the latest news from the OneHealth programme,
  • Offer all Renault Group employees tools and services to take care of their health and well-being,

This list is not exhaustive and may be modified at any time by Renault without any liability on its part.

3 - Access to the Site

The website can be accessed via the Internet at the following address

4 - Licence to use the Site

RENAULT grants the User a personal, non-exclusive, revocable, non-transferable and non-assignable right to use the Site, the Content and its Elements free of charge.

This licence is granted to the User solely for his or her own needs, to the exclusion of any commercial or lucrative use of all or part of the Content and/or Elements.

The User acquires no other rights to the Site, the Content and/or the Elements than those granted herein.

5 - Obligations of the User

The User undertakes to use the Site in accordance with national and international regulations.

In particular, he/she undertakes to:

  • to familiarise himself with these GTU and to comply with them,
  • not to reproduce, even temporarily and/or partially, the Site and/or its Content, by any means and in any form whatsoever,
  • not to access and/or use the software components of the Site,
  • not to use software or processes intended to copy the Content and/or likely to disrupt the proper functioning of the Site,
  • not to adapt, modify, translate, transcribe, transcribe, compile, decompile, assemble or disassemble all or part of the Site, the Elements and/or the Content,
  • not export the Site and/or merge it with other software,
  • inform RENAULT if it becomes aware of any act of piracy and/or unlawful or non-contractual use of the Site and/or its Content,
  • not carry out any manipulation and/or introduce any virus or malicious code likely to cause computer and/or functional faults likely to affect the proper functioning of the Site or the Elements accessible via the Site.
  • hinder the proper functioning of the Site by any means whatsoever,
  • not use the Site to display, download or transmit any content contrary to decency or public order (such as, but not limited to, any content of a racial, political, religious, pornographic or sexual nature).

As the User is solely responsible for the use of the Site, the User acknowledges that neither RENAULT nor the members of its distribution network may be held liable for any direct or indirect damage, and in particular for material or immaterial damage, loss of data or software, or financial loss, resulting from access to or use of the Site, or due, in particular, to the interruption, suspension or modification of the Site or of any of its Elements.

6 - Availability of the Site

RENAULT undertakes to make every effort to ensure the security of access, consultation and use of the Site.

The Site is accessible at all times, except in the event of force majeure or events beyond RENAULT's control, and subject to any breakdowns and maintenance operations necessary for the proper functioning of the Site.

7 - Liability - Warranty

Use of the Site

Within the limits of the applicable laws and regulations, neither RENAULT nor the dealers of its sales network accept any liability for the use of the Site by the User and offer no explicit or implicit guarantee as to the speed or operation of the Site. In particular, access to the Site may be temporarily and periodically suspended for technical reasons; in this case, the technical teams will make every effort to resolve the problem as quickly as possible.

RENAULT reserves the right to modify, at any time and without prior notice, the information contained on the Site, without RENAULT and/or the members of its distribution network and/or its subsidiaries being held liable in this respect.

Access to and use of the Site is at the User's own risk. It is the responsibility of the User to take all appropriate measures to protect his own data and/or software stored on his telephone and computer equipment against any attack.

In any event, RENAULT shall be exempt from any liability:

  • in the event of non-compliance with these GTU by the user;
  • in the event of malfunctioning of the Site due to a cause, whether voluntary or involuntary, attributable to the User or to a third party or to a wilful act, of the software, of the smartphone/tablet, of an interface or of any other product or supply of the User;
  • in the event of malfunction and/or failure of the User's computer and/or communications network, whatever the cause.

RENAULT does not guarantee that the Site is free of errors or anomalies, nor that it may be subject to attack, in particular by viruses, which may cause malfunctions, interruptions, breakdowns or loss of data or information.

8 - Personal data

Use of the Site may require RENAULT to collect personal data allowing the direct or indirect identification of the User.

9 - Intellectual and industrial property

The Site and its Content are protected by intellectual and/or industrial property rights.

The photographs, texts, slogans, drawings, images, animated sequences with or without sound, as well as all works included on the Site are the property of RENAULT or of third parties who have assigned their rights to RENAULT or authorised RENAULT to use them.

The vehicle models presented on the Site are protected by copyright and by articles L511-1 et seq. of the French Intellectual Property Code relating to the protection of registered models.

The RENAULT names, the names of the vehicles in the RENAULT range and of the products and services associated therewith, the slogans and logos accompanying these brands are, unless otherwise indicated, trademarks registered by RENAULT or by other companies in the Renault Group.

Other trademarks that may also be cited are used by Renault with the authorisation of their owner or simply as an indication of products or services offered by Renault.

Reproductions of the Content on paper or computer media are authorised provided that they are strictly reserved for personal use excluding any use for advertising and/or commercial and/or information purposes and that they comply with the provisions of article L122-5 of the French Intellectual Property Code.

With the exception of the above provision, the reproduction, imitation, use or fixation, by any process and on any medium whatsoever, of all or part of the Content without having obtained the prior authorisation of RENAULT or of the holder(s) of the corresponding rights constitutes an infringement punishable by four years' imprisonment and a fine of 400,000 euros.

10 - Applicable law

The Site and these GTU are governed by French law, subject to the mandatory rules of the User's country of residence.

Any dispute relating to the interpretation and/or execution of these TOU shall be settled out of court.

In the absence of an amicable solution, the dispute shall be submitted to the jurisdiction of the Paris courts, to which the parties confer exclusive jurisdiction, without prejudice to the plurality of defendants or claims for compensation by third parties.

11 - Updating of the TOU

RENAULT reserves the right to modify and update these TOU without notice, at any time and without prior notice to Users.

Where applicable, modifications and updates shall be binding on the User as soon as they are published on the Website, and it is the responsibility of the User to consult the GTU in force each time he/she connects to the Website.

12 - Miscellaneous provisions

12.1 No waiver

The fact that one of the parties does not invoke a clause of these TOU shall not be interpreted as a temporary or definitive waiver of the benefit of the provision in question, which shall remain in force.

 

12.2. Invalidity of a clause

In the event that one or more of the provisions of these TOU are declared invalid, void or unwritten as a result of the regulations in force, of a development or following a final decision by a competent court, the other provisions will retain their full force and scope, with the parties undertaking to establish as soon as possible a valid replacement provision with an equivalent scope that comes as close as possible to the spirit of these TOU.

 

12.3 Force majeure

The following are expressly considered to be cases of force majeure, in addition to those normally accepted by the case law of the French courts: inclement weather, governmental and legal restrictions and modifications, computer breakdowns and telecommunications blockages, the failure of RENAULT's servers and any other event beyond the express control of RENAULT.
